Terms of Service
Effective October 19, 2026
The short version: UpYours helps your real customers write and post honest reviews. Ask every customer (not just the happy ones), never pay for or fake reviews, follow the review sites' rules, and keep your account secure. You can cancel anytime.
These terms are an agreement between you and Up Your Reviews ("UpYours," "we," "us") for using upyours.reviews, the business portal at app.upyours.reviews, and the review pages we host (the "Service"). By creating an account or using the Service, you agree to these terms and our Privacy Policy. If you use the Service for a business, you agree on that business's behalf and confirm you're authorized to.
1. The Service
UpYours gives your business a review page, links and tools to share it, and helps your customers turn their own words into a review they post themselves on sites like Google, Yelp or BBB. UpYours never posts reviews for anyone, and we don't control those sites — they decide whether to publish, filter or remove reviews. We don't guarantee any number of reviews, ratings or results.
2. Your account
- You must be at least 18 and give accurate information.
- Keep your sign-in secure. You're responsible for activity on your account; tell us right away if you think it's been accessed without permission.
- You may only connect review-site links, logos and web addresses that belong to your business or that you have the right to use.
3. Honest reviews — rules you agree to follow
Fake and manipulated reviews hurt consumers and are illegal in many cases, including under the FTC's rule on consumer reviews and testimonials. When using UpYours you agree not to:
- Write, or have anyone other than a genuine customer write, reviews of your business — including staff, family or paid reviewers.
- Offer payment, discounts, gifts or anything else of value in exchange for a review, or for a positive review.
- Only ask customers you expect to be happy, or steer unhappy customers away from posting (sometimes called "review gating").
- Pressure customers about what to write, or post reviews about competitors.
- Break the rules of the review sites you send customers to. Some sites limit or discourage asking for reviews at all — it's your responsibility to know and follow their policies.
UpYours drafts are a starting point built from what the customer chooses and writes; customers can edit them and decide whether to post. We may suspend accounts that misuse the Service.
4. Messages you send
UpYours helps you text or email your review link from your own phone, email or business software. You're responsible for those messages, including having permission to contact your customers and following laws such as the TCPA, CAN-SPAM and state rules on texting and calling.
5. Free trial, subscription and cancellation
- New accounts get a free trial (currently 14 days, no card required). After the trial, a paid subscription is needed to keep your review page live. Your settings and history stay in your account either way.
- Subscriptions renew automatically each month until canceled. You can cancel anytime from the portal; your subscription stays active until the end of the paid period. Except where required by law, payments aren't refundable.
- If a payment fails, your review page may pause until it's resolved.
- We may change prices with at least 30 days' notice; changes apply from your next billing period.
- Payments are processed by our payment processor under its terms.
6. Your content
You keep ownership of what you upload or enter — your logo, business details, messages and settings ("Your Content"). You give us a license to host, display and use Your Content only to provide and improve the Service, for example showing your logo on your review page. Customer submissions on your review page are made available to your account for your use, subject to our Privacy Policy and applicable law.
7. Acceptable use
Don't use the Service to break the law, infringe others' rights, upload anything harmful or offensive, attempt to access other accounts or our systems without permission, interfere with the Service, or resell it without our written permission.
8. Our property
The Service, including its software, design and the UpYours name and logo, belongs to us. These terms don't give you any rights to it other than to use the Service as described here.
9. Suspension and termination
You can stop using the Service and close your account at any time. We may suspend or end your access if you break these terms, if your use creates legal risk or harm, or if we stop offering the Service — with notice where reasonable. Sections that by their nature should survive (such as ownership, disclaimers and limits of liability) survive termination.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that any review site will accept or keep any review.
11. Limitation of liability
To the fullest extent the law allows, UpYours won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you haven't paid us anything.
12. Indemnity
You agree to defend and hold us harmless from claims arising from Your Content, your messages to customers, or your violation of these terms or the law — including the review rules in section 3.
13. Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Ohio, and you consent to their jurisdiction.
14. Changes to these terms
We may update these terms. If changes are material, we'll update the date above and notify account holders by email or in the portal before they take effect. Continuing to use the Service after that means you accept the updated terms.
